These Terms of Use (“Terms”) govern your access to and use of the Unleesh platform, including the website located at app.unleesh.com, any related websites, mobile applications, and services (collectively, the “Platform”), operated by Unleesh LLC (“Unleesh,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Overview of Services

Unleesh is a software platform that enables:

• Group travel organizers (“Operators”) to create, manage, and sell travel experiences

• Travelers (“Users”) to register, communicate, prepare for, and participate in group travel experiences

• Coordination of logistics, onboarding, communications, and payments related to travel experiences

Unleesh is not a travel agency, tour operator, or transportation provider, unless explicitly stated in writing.

2. Eligibility

You must:

• Be at least 18 years old (or have parental/guardian consent)

• Have the legal capacity to enter into a binding agreement

• Provide accurate and complete information

If using the Platform on behalf of an organization, you represent you have authority to bind that entity.

3. Account Registration

To use certain features, you must create an account.

You agree to:

• Provide accurate, current, and complete information

• Maintain confidentiality of your login credentials

• Be responsible for all activity under your account

We may suspend or terminate accounts for inaccurate information or misuse.

 

4. Role of Unleesh

4.1 Platform Provider Only

Unleesh provides technology to facilitate travel experiences but does not:

• Own, operate, or control travel services

• Guarantee quality, safety, or legality of trips

• Act as an agent for Operators or Travelers (unless explicitly stated)

4.2 Operator Responsibility

Operators are solely responsible for:

• Trip content, pricing, and logistics

• Compliance with laws and regulations

• Delivering the travel experience

4.3 Traveler Responsibility

Travelers are responsible for:

• Reviewing trip details before booking

• Meeting all travel requirements (passports, visas, vaccinations, etc.)

• Following Operator rules and instructions

 

5. Payments and Fees

• Payments may be processed through third-party providers (e.g., Stripe)

• Unleesh may charge platform or service fees

• All pricing is set by Operators unless otherwise specified

• Refund policies are determined by the Operator unless stated otherwise

You agree to pay all applicable fees and authorize us or our partners to process payments.

 

6. Acceptable Use

You agree NOT to:

• Use the Platform for unlawful purposes

• Upload false, misleading, or harmful content

• Interfere with Platform security or operations

• Reverse engineer or copy the Platform

• Circumvent payment systems

We reserve the right to suspend or terminate accounts for violations.

7. User Content

You may submit content (e.g., profiles, trip data, messages, media) (“User Content”).

You:

• Retain ownership of your content

• Grant Unleesh a worldwide, non-exclusive, royalty-free license to use, display, and process it to operate the Platform

You represent that:

• You have rights to your content

• It does not violate laws or third-party rights

 

8. Communications

By using the Platform, you agree to receive:

• Transactional communications (trip updates, notifications)

• Operational communications (account or service updates)

You may opt out of marketing communications where applicable.

 

9. Third-Party Services

The Platform may integrate with third-party services (payments, messaging, mapping, etc.).

We are not responsible for:

• Third-party performance

• External terms or policies

• Losses caused by third-party services

 

10. Intellectual Property

All Platform content (excluding User Content), including:

• Software

• Design

• Branding

• Features

is owned by Unleesh or its licensors.

You may not:

• Copy, distribute, or create derivative works

• Use trademarks without permission

 

11. Privacy

Your use of the Platform is subject to our Privacy Policy.

You acknowledge that:

• You may share personal data with Operators

• Operators may independently process your data

 

12. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

We do not guarantee:

• Availability or uptime

• Accuracy of content

• Safety or quality of travel experiences

Travel involves inherent risks. You assume all risks associated with participation.

 

13. Limitation of Liability

To the maximum extent permitted by law:

Unleesh shall not be liable for:

• Indirect, incidental, or consequential damages

• Loss of profits, data, or business

• Personal injury or property damage related to travel

Our total liability shall not exceed the amount you paid to Unleesh in the past 12 months.

 

14. Indemnification

You agree to indemnify and hold harmless Unleesh from claims arising out of:

• Your use of the Platform

• Your content

• Your violation of these Terms

• Your participation in travel experiences

 

15. Termination

We may suspend or terminate your access:

• For violations of these Terms

• For legal or operational reasons

You may stop using the Platform at any time.

 

16. Modifications to Terms

We may update these Terms at any time.

Continued use of the Platform constitutes acceptance of the updated Terms.

 

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

Any disputes shall be resolved in courts located in Los Angeles County, California.

 

18. Miscellaneous

• These Terms constitute the entire agreement between you and Unleesh

• If any provision is invalid, the remainder remains in effect

• No waiver of any term shall be deemed a continuing waiver
